27th December,2023 : On the instructions from President TPAA Shri Dharminder Sikka, members from all over Punjab through their respective District Presidents handed over Representation to the DETCs, AETCs, STOs with request to stop immediately issuing SCN vide GST Form DRC-01, as these notices are being served upon registered persons based on unscrutinized and unverified data for the year 2018-19. As such, such notices bear no legal ground and only being served in vague, unjustified and illegal manner.
Shri Sikka ji told that prior to issue Form DRC-01, the erring entity should be served information vide Form ASMT-10 giving atleat 30 days to clarify his position on GST Form ASMT-11 and in case, the Officer concerned is not satisfied with the reply, he may serve DRC-01 and that too on the factual base with sufficient proof. But in these cases, no procedure have been followed and only on the instance of an IT firm, hired by the State Government, who without considering Exempted Purchase & Sales figures, preparing DRC-01 notices to be issued by the concerned Officers, who, further without verifying the actual data figures, put their signatures and Dispatch number, serves such illegal notices. As such, these notices are totally against the law of the land. He further told, these notices be immediately quashed and business entities be given proper opportunity to reply according to law.
Jalandhar team gave Representation under the leadership of Sikka ji, Ludhiana team under Shri Naresh Chalotra ji, Amritsar team under Shri Ravinder Datta, Ferozpur team under Shri Charanjit Singh, Pathankot team under Shri Puneet Ohri, Rajpura team under Shri Subhash Dua, Mansa team under Shri Happy Bansal, Phagwara team under Shri Jaswinder Singh Chaggar, Nawanshehr team under leadership of Shri Suresh Kumar handed over Representation to respective DETCs, AETCs and STOs of their Districts. All the Officers concerned assured of full cooperation in this matter.
Shri Varinder Sharma, the General Secretary TPAA told the press reporters that a separate Memorandum along with these Representation have already been forwarded through different emails.
